TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern your use of the Blacksmith Tactical website and your purchase of products from Blacksmith Tactical. Please read them carefully before using our website or placing an order.

By using our website or placing an order, you acknowledge that you have read, understood, and agree to these Terms.

1. ABOUT BLACKSMITH TACTICAL

Blacksmith Tactical (“Blacksmith Tactical,” “we,” “us,” or “our”) operates blacksmithtactical.com and sells custom-made holsters, firearm accessories, apparel, and related products.

2. ELIGIBILITY

You must be at least 18 years old and legally capable of entering into a binding contract to place an order through our website.

You are responsible for complying with all applicable federal, state, and local laws concerning any products you purchase, possess, or use.

3. ORDERS

By placing an order, you represent that:

  • The information you provide is accurate and complete;
  • You are authorized to use the payment method submitted; and
  • You have reviewed and confirmed the products, options, and configurations selected before submitting your order.

We reserve the right to refuse, cancel, or limit an order when reasonably necessary, including because of suspected fraud, payment problems, pricing or listing errors, product availability, legal or regulatory concerns, or other circumstances affecting our ability to fulfill the order.

If we cancel an order for which payment has already been collected and no product is provided, the applicable payment will be refunded.

4. CUSTOM-MADE HOLSTERS

Blacksmith Tactical holsters are manufactured to order according to the options selected by the customer.

Because production may begin shortly after an order is placed, custom holster orders are final sale and are not eligible for cancellation, return, refund, or exchange because of a change of mind or customer ordering error.

Customers are responsible for carefully reviewing all selections before placing an order.

These selections may include, as applicable:

  • Firearm manufacturer and model;
  • Firearm generation or variant;
  • Barrel or slide length;
  • Weapon-mounted light;
  • Right- or left-handed configuration;
  • Holster style;
  • Carry configuration;
  • Color or pattern;
  • Sweat guard;
  • Belt attachment or hardware;
  • Optic or sight configuration; and
  • Other options offered on the product page.

If you discover a significant ordering mistake after placing your order, contact us as soon as possible. If production has not progressed too far, we may attempt to accommodate a change at our discretion.

We do not guarantee that an order can be changed or canceled after it has been submitted.

Nothing in this section eliminates remedies that may be available when Blacksmith Tactical manufactures or ships a product that materially differs from the configuration actually ordered or when a product is covered by our Limited Lifetime Warranty.

5. FIREARM, LIGHT, AND ACCESSORY COMPATIBILITY

Holsters are designed for the specific firearm and, where applicable, weapon-mounted light or other configuration identified in the product listing and customer order.

Compatibility with one firearm, light, accessory, generation, or variant does not imply compatibility with another, even when products appear physically similar.

For light-bearing holsters, the specified weapon-mounted light may be an integral part of the holster's fit and retention system. A holster designed for a particular firearm/light combination should not be assumed to function properly with the light removed or with a different light installed.

Aftermarket firearm modifications or accessories—including frames, slides, compensators, threaded barrels, gas pedals, takedown levers, optics, sights, grip modifications, or other components—may affect holster fit or function.

Unless Blacksmith Tactical expressly identifies a particular configuration as compatible, the customer is responsible for confirming compatibility before ordering.

We are happy to answer compatibility questions before an order is placed.

6. RETURNS AND EXCHANGES

Custom-made holsters are final sale except in cases involving a qualifying defect, Blacksmith Tactical fulfillment error, or other circumstances covered by our Returns/Warranties Policy or applicable law.

Eligible non-custom accessories and electrical components may be returned within 30 days if they remain unopened and the original packaging is in its original condition.

Customers are responsible for return shipping on eligible voluntary returns, and a 5% restocking fee applies.

Products must not be returned without first contacting Blacksmith Tactical and receiving return instructions.

Our complete Returns/Warranties Policy is incorporated into these Terms and provides additional information concerning returns, warranty claims, shipping responsibilities, and exclusions.

If these Terms and the Returns/Warranties Policy appear to conflict regarding a return or warranty claim, contact us for clarification before returning a product.

7. LIMITED LIFETIME WARRANTY

Blacksmith Tactical provides a Limited Lifetime Warranty on Blacksmith Tactical holsters and related Blacksmith Tactical products, subject to the terms, limitations, and exclusions stated in our Returns/Warranties Policy.

The warranty is non-transferable and applies only to the original purchaser.

If a covered product is determined by Blacksmith Tactical to have a defect in materials or workmanship, we may repair or replace the product at our discretion.

The Limited Lifetime Warranty does not cover circumstances identified in our Returns/Warranties Policy, including normal wear and tear, cosmetic damage that does not affect function, misuse, neglect, accidents, improper maintenance, unauthorized modification, incompatible equipment, heat damage, lost hardware, or fit/function problems caused by third-party firearm modifications or unsupported accessories.

Third-party products may be covered by warranties offered by their respective manufacturers. Any manufacturer warranty is governed by that manufacturer's terms, conditions, and eligibility requirements.

This Limited Lifetime Warranty gives you specific legal rights, and you may also have other rights that vary by jurisdiction.

8. SAFE FIREARM AND HOLSTER USE

Firearms are inherently dangerous and must be handled responsibly. The safe handling, carrying, storage, and use of a firearm are the responsibility of the firearm owner and user.

Before using any Blacksmith Tactical holster, the user is responsible for confirming that the holster is appropriate for the specific firearm and configuration being used.

Before carrying or using a holster with a loaded firearm, always verify fit, retention, trigger-guard coverage, and proper function using a completely unloaded firearm.

Do not use a holster if it is damaged, excessively worn, improperly fitted, incompatible with the firearm or installed accessories, or if it permits unintended access to or movement of the trigger.

The user is responsible for:

  • Following all applicable firearm safety rules and the firearm manufacturer's instructions;
  • Knowing the condition of the firearm at all times;
  • Confirming that the firearm and any installed accessories are compatible with the holster;
  • Testing fit and retention with the firearm completely unloaded before carrying a loaded firearm;
  • Ensuring that clothing, drawstrings, foreign objects, or other materials do not enter the holster or trigger-guard area during holstering;
  • Exercising appropriate care when holstering and drawing a firearm;
  • Properly installing, adjusting, and maintaining holster hardware;
  • Regularly inspecting the holster and its hardware for wear, damage, loosening, deformation, or other conditions that could affect safe operation; and
  • Immediately discontinuing use of a holster that is damaged, improperly fitted, or no longer functions as intended.

Whether a firearm is carried with a cartridge in the chamber is the decision and responsibility of the firearm owner and user. Users should consider the firearm manufacturer's instructions, their training and competency, applicable law, the specific firearm, and the method of carry.

A holster is not a substitute for proper firearm handling, training, or judgment. No holster can prevent injury resulting from negligent, reckless, or unsafe firearm handling.

To the fullest extent permitted by applicable law, Blacksmith Tactical is not responsible for injuries, losses, or damages resulting from unsafe firearm handling, negligent or improper use, use with incompatible firearms or accessories, unauthorized product modifications, failure to properly inspect or maintain the product, or use of a product after it has become damaged or unsuitable for continued use.

9. FIREARM LAWS

Blacksmith Tactical does not provide legal advice regarding firearm ownership, possession, transportation, carry, or use.

Laws vary by jurisdiction and may change.

You are solely responsible for determining whether your purchase, possession, installation, carry, or use of any product complies with applicable federal, state, and local law.

10. PRICING AND PAYMENT

Prices are stated in U.S. dollars unless otherwise indicated.

We may change prices before an order is placed and may correct typographical, pricing, or product-description errors.

Payments are processed through third-party payment providers. Availability of particular payment methods may vary.

We are not responsible for payment authorization failures, holds, delays, or other issues caused by independent payment providers.

11. CHARGEBACKS AND PAYMENT DISPUTES

If you believe there is a problem with an order or charge, please contact Blacksmith Tactical so that we have an opportunity to investigate and resolve the issue.

We reserve the right to respond to chargebacks and payment disputes with relevant documentation, which may include order records, customer selections, tracking information, communications, production records, and applicable policies.

Nothing in these Terms prevents a customer from exercising rights provided by applicable law or by the customer's payment provider.

12. WEBSITE INFORMATION

We make reasonable efforts to accurately display product descriptions, specifications, photographs, colors, availability, and pricing.

However, minor variations may occur, particularly with colors, patterns, materials, manufacturing tolerances, screen displays, and handmade or custom-produced products.

We may correct errors or update website information without prior notice.

13. INTELLECTUAL PROPERTY

The Blacksmith Tactical website and its original content, including photographs, product designs and descriptions, graphics, logos, text, and other materials, are owned by or licensed to Blacksmith Tactical and may be protected by copyright, trademark, and other intellectual-property laws.

You may not reproduce, distribute, commercially exploit, or create unauthorized derivative works from our protected content without permission.

References to third-party firearm manufacturers, firearm models, accessories, lights, optics, trademarks, or brand names are used for identification and compatibility purposes and do not necessarily indicate sponsorship, affiliation, or endorsement.

14. THIRD-PARTY SERVICES AND LINKS

Our website may use or link to services operated by third parties, including payment providers and other technology providers.

Those third parties operate under their own terms and privacy practices.

Blacksmith Tactical is not responsible for the content, availability, security, policies, or practices of independent third-party websites or services.

15. DISCLAIMER OF WARRANTIES

Except for the express Limited Lifetime Warranty described in our Returns/Warranties Policy, and to the fullest extent permitted by applicable law, the website and services are provided without additional warranties, whether express, implied, or statutory.

To the fullest extent permitted by applicable law, we disclaim implied warranties that may otherwise apply, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes or limits any warranty or consumer right that cannot lawfully be excluded or limited.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Blacksmith Tactical will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to the website, an order, or a product.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.

To the fullest extent permitted by applicable law, Blacksmith Tactical's aggregate liability arising from a product or transaction will not exceed the amount paid to Blacksmith Tactical for the product giving rise to the claim.

These limitations do not apply to the extent prohibited by applicable law.

17. PRIVACY

Our collection and use of personal information is governed by our Privacy Policy.

Our Privacy Policy is incorporated into these Terms by reference.

18. FORCE MAJEURE

Blacksmith Tactical is not responsible for delays or failure to perform caused by events reasonably beyond our control, including natural disasters, severe weather, fire, power or internet outages, carrier disruptions, supply shortages, equipment failures, governmental actions, labor disruptions, or similar events.

We will make reasonable efforts to resume affected operations when circumstances permit.

19. GOVERNING LAW

These Terms and any dispute arising from them are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.

20. DISPUTE RESOLUTION

Before filing a lawsuit concerning an order or these Terms, you and Blacksmith Tactical agree to make a reasonable good-faith effort to resolve the dispute directly.

Nothing in this provision prevents either party from pursuing a claim in small claims court when eligible or from seeking relief when an immediate legal remedy is reasonably necessary.

Any legal proceeding concerning these Terms or an order shall be brought in a court of competent jurisdiction in Texas, subject to any venue or jurisdiction rights that cannot legally be waived.

21. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary, and the remaining provisions will remain in effect.

22. WAIVER

Failure by Blacksmith Tactical to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision in the future.

23. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Returns/Warranties Policy, product-specific disclosures, and other policies expressly incorporated into an order, constitute the agreement between you and Blacksmith Tactical concerning your use of the website and purchase of products.

24. CHANGES TO THESE TERMS

We may update these Terms from time to time.

Changes will be reflected by updating the “Last Updated” date. Changes generally apply prospectively and do not retroactively alter the material terms applicable to an order already placed unless required by law or agreed to by the parties.
